NOTICE FOR THE RECTIFICATION OF UNLAWFUL COMMENCEMENT OR CONTINUATION OF A LISTED ACTIVITY IN TERMS OF SECTION 24g of the national environmental management act, act no. 107 of 1998, AS AMENDED. REF NO.: TO BE CONFIRMED UPON SUBMISSION OF APPLICATION TO THE CA

This advertisement serves to inform you, as a potential Interested and Affected Party (I&AP), of the application in terms of Section 24G of NEMA for the rectification of unlawful commencement or continuation of listed activities in terms of the National Environmental Management Act, Act No. 107 of 1998, as amended, for Mr. B Losch and Mrs. A Losch. The Section 24G application will be lodged with the Gauteng Department of Agriculture and Rural Development (the Competent Authority [CA]) in terms of the National Environmental Management Act (NEMA), 1998 (Act No. 107 of 1998), as amended. Labesh (Pty) Ltd has been appointed by the applicant, Mr. B Losch and Mrs. A Losch, in terms of Regulation 12 of the EIA Regulations (GNR. 982 of 4 December 2014), as amended, as the independent Environmental Assessment Practitioner (EAP) tasked with conducting the above-mentioned application processes. Labesh complies with the necessary requirements of Regulation 13 of GNR. 982 of 4 December 2014, as amended.

PROJECT DESCRIPTION: The applicant commenced with the development of a lodge with the inclusion of a function venue and accommodation for roughly sixteen (16) people (6x bungalows, bridal and groom suite of which each sleep two (2) people) without obtaining prior environmental authorisation.

PROJECT LOCATION: GPS Coordinates: 25°54’15.17″S; 28°27’41.52″E (Portion 75 of the Farm Klipkop 396 JR), City of Tshwane Metropolitan Municipality, City of Tshwane, Gauteng Province.

APPLICABLE LEGISLATION: The project requires Section 24G Environmental Authorisation (ex post facto approval) for the following listed activities in terms of the National Environmental Management Act, Act No. 107 of 1998, as amended, and the Environmental Impact Assessment Regulations, 2014, as amended:

  • GNR. 985 of 4 December 2014 (Listing Notice 3), as amended: Activity No. 6: The development of resorts, lodges, hotels and tourism or hospitality facilities that sleeps 15 people or more. C. Gauteng iv. Sites identified as Critical Biodiversity Areas (CBAs) or Ecological Support Areas (ESAs) in the Gauteng Conservation Plan or in bioregional plans.
  • GNR. 985 of 4 December 2014 (Listing Notice 3), as amended: Activity No. 12: The clearance of an area of 300 square metres or more of indigenous vegetation except where such clearance of indigenous vegetation is required for maintenance purposes undertaken in accordance with a maintenance management plan. c. Gauteng ii. Within Critical Biodiversity Areas or Ecological Support Areas identified in the Gauteng Conservation Plan or bioregional plans.

PUBLIC PARTICIPATION PROCESSES: The public participation processes for the above-mentioned application are conducted in accordance with the requirements outlined in Government Notice 698 of 20 July 2017, in terms of the National Environmental Management Act, Act No. 107 of 1998, as amended. Registration of Interested and Affected Parties for the Section 24G Application will be available for a period of 20 days from 4 August 2025 until 26 August 2025. Should you wish to register as an I&AP for the project and be kept informed of the progress of the project and public participation opportunities or provide any comments in terms of this application, please request and complete an “Interested and Affected Party” registration form (obtainable from the EAP).
